DBS Barring and Legal Duty to Refer Workshop
The DBS Regional Outreach team provides advice and guidance to both employers and voluntary organisations on DBS products and services. This includes supporting organisations to understand eligibility for DBS checks and helping to ensure that they are requesting the correct level of check for the role, as well helping understand when their legal duty to make a referral to DBS is met.
Did you know if you have staff or volunteers engaging in regulated activity (they have an enhanced with barred list DBS) check you have a legal duty to refer to the DBS if you remove them from regulated activity due to harm or relevant conduct.
The workshop will cover:
- the benefits of DBS and your organisation working together
- what ‘regulated activity’ is
- when a DBS barring referral should be made, including when the legal duty is met
- the three different referral routes
- how to make a good quality referral
- the consequences of not making appropriate barring referrals
- the consequences of being included on one or both Barred Lists
This session is aimed that those who are involved in HR, management of those in regulated activity, those who have safeguarding responsibilities, trustees and those who would be involved in making referrals to the DBS.
Please note we cannot discuss individual cases during the session.
